General News: PILOT BY HELICOPTER - INCREASE OF SERVICE FEE
News Due to a reduction in the nuber of assignments using helicopter services over the past few months, the NCA have to, in accordance with clause 8.3 in the contract agreement, increase the services fee for helicopter transport of pilots.

The cost per boarding will from 15. July 2010 be as follows:

Type of Helicopter:  AS365N3
Rates per boarding, Karsto, Sture and Mongstad:  NOK 65.600,00
Rates per boarding Nyhamna, boarding at Fedje:   NOK 65.600,00
Positioning flights to/from Aalesund and when using back-up helicopter: NOK 16.151,00 (rates are per flight hour)

The NCA will monitor the number of assignments closely in the coming months and consider a new price regulation if necessary.

General News: Restrictions related to the implementation of new NGL metering station at Karsto Gas Plant
News

Please be advise that we have received the following information from GASSCO A/S:

In accordance with authority regulations, the Karsto Gas Plant is installing new NGL metering stations.

One of the existing two propane metering stations will be removed approximately 1. July 2010.

The remaining propane metering station has the following restrictions:

    • Minimum start-up rate is 300 m3/hr.  Consequently small vessels may not be accepted in this period.
    • Loading of coolant gas will be difficult due to this restriction o­n the loading rate.
    • It will not be possible to load two propane vessels simultaneously in this period.

The restricted period will last from 1.July 2010 to approximately 15.November 2010.

Also, please be aware that it is not possible to load any propane from 1. July to 8.July due to tie-in operations.

This will be planned for the July lifting programme.

General News: PROPOSAL RELEVANT TO NEW PILOT- AND COASTAL DUES SUBMITTED FOR HEARING
News

The Norwegian Coastal Administration (NCA) has submitted a proposal relevant to alterations in the coastal dues, Pilot Exemption Certificate regulations etc.

The consequences of the new proposal will most probably be that coasters transporting dry cargo and passengers will benefit from the alterations whereas international traffic, and in particular tankers and lpg/lng ships will be charged higher fees.

The main issues for tankers calling in the Province of Rogaland (including Kårstø, Karmøy, Stavanger, Sauda etc.) will be:

  1. Pilot is compulsory; Even if the Master is in possession of a valid pilot exemption certificate, sailing without a pilot cannot be granted if a vessel is loaded with liquid product with a flashpoint below 23 deg.c (oil,gas etc.).
  2. Double hull oil tankers are granted a deduction in the fees (as per today)
  3. Tankers of 30.000 grt and above arriving in ballast, which are not calling a port for loading, are granted permission to embark / disembark the pilot in Kvitsøy boarding ground no.2. This will exempt the vessel from the costs of boarding / disembarking pilot by helicopter.
  4. A safety fee (as per today) for Kvitsoy VTS will be charged for all ships calling in the region. The fee is nok 0,99 pr grt for ships calling at Kårstø, and nok 0,27 pr grt for vessels calling other ports.

As a comment to the proposal (whish has been presented to the NCA) we have concluded as follows :

  1. Remove embarking /disembarking of pilot by helicopter for all vessels of 30.000 grt and above, which do not carry dangerous or polluting cargo (incl. tankers in ballast).
  2. Remove the VTS fee for vessels calling all other ports in our region, but Kårstø Gas terminal.
  3. Warrant a dimidiating of the coastal fee for vessels calling for docking or repairs.
  4. Refuse deductions in the remote parts of Norway (which is considered to be a part of a regional policy) at the expense of other shipping groups and other parts of the country.
  5. Avoid too high requirements to obtain a pilot exemption certificate, when the navigator has regularly sailed in the waters for years.
  6. Refuse imposition of new and increased coastal fees in those cases where a vessel has sailed within Norwegian coastal waters of more than 5 days.

General News: New Port State inspection regime in Europe
News The new inspection regime (NIR) from 1. January 2011

As a conequence of the adoption of the revised EU directive on port state control, Directive 2009/16/EC of 23. April 2009, the parties to the European Port State Control regime (PMOU) have developed a New Inspection Regime (NIR) which will enter into force on 1. January 2011.

Consequently ship owners/managers should be aware of the following obligations:

- In order to establish the new database THETIS for publishing a ship's risk profile
(category), certain information has to be provided by the owner/manager for
each ship via a website to be established prior to 1. January 2011.

- From 1. January 2011, a pre-arrival notification shall be submitted either at least
24 hours (as today) or at least 72 hours in advance. The latter shall be given for
ships subject to an expanded inspection. This information will be made available
online.

available in due course on the websites of EMSA and PMOU as follows:

Current reporting requirements for enhanced inspection:

Owners/managers should also be aware of the existing requirement that ships eligible for Mandatory Enhanced Inspection (MEI) are required to notify the next port minimum 3 days in advance or prior to departure from the previous port if less than 3 days.

We have been informed that a relatively large fraction of ships due for enhanced inspection fail to report this as required may risk delay, and they will normally be heavily fined for such non-compliance.

General News: Karsto Gas terminal; increased port costs from 01.March 2010
News News The rates for tugs, linesmen and ships waste disposal, have from 01.March 2010 increased from Nok 12,00 per NRT to Nok 14,70 per NRT. This rate is applicable for vessels with double hull and SBT, and is also concidered as a minimum rate.

For vessels without double hull, the following rates apply:

Vessels with double bottom and SBT: 10% increase (from Nok 13,20 to Nok 16,17 per NRT)
Vessels with double sides and SBT: 15% increase (from Nok 13.80 to Nok 16,91 per NRT)
Vessels with single hull and SBT: 20% increase (from Nok 14,40 to Nok 17,64 per NRT)

The total costs for tugs, linesmen and ships waste disposal will be invoiced jointly.

General News: Our view on the NOx Tax regime
News There has been 2 alternative ways of paying & calculating Nox Tax on emissions Norwegian coastal voyages. These are:

Joining the Nox Fund (see weblink: http://www.nho.no/the-nox-fund/the-business-sector-s-nox-fund-article19396-473.html). In doing so owners had to have specific ships joining and undertaking an obligation and/or plan to invest in NOx limiting measures. The Nox Tax for ships in the Nox Fund is NOK 4,00 per kg Nox
The other alternative was not joining the Nox Fund hence not undertake any obligation, but pay the Nox tax amounting to NOK 15,85 per kg Nox


We now understand that owners can enter any ship into the Nox Fund without any obligation to invest in NOx-limiting measures. We would therefore recommend to our principals that you enter your ships into this fund thereby reducing the Nox Tax from NOK 15,85 (2009 level) / NOK 16,14 (2010 level) to NOK 4,00

General News: The business-sectors NOx-fond -affiliation and duties
News When discussing the Environmental Agreement with ESA – the EFTA Surveillence Authority in Brüssels they wanted elements in the agreement that gave the NOx-fund a possibility to get hold of cost-effective projects if the Fund needed them to fulfill the obligation to reduce NOx-emissions. That is why the affiliation agreement has obligations to evaluate NOx reducing measures within the company and an obligation to send such plans to the fund within two years if called for.

During 2009 it has been evident that the Fund will not have to find measures from such company plans to fulfill the obligations in the Agreement. Right now support has been given of nearly 200 mill € with a reduction of around 25 000 tons of NOx yearly from nearly 500 different projects. That is beyond the obligations of the Agreement which is expected to be of 16 000 tons of NOx between 2008 and 2011. This is also very close to the maximum total support available for NOx-reductions.

It has never been an obligations for companies to undertake measures to reduce NOx-emissions without financial support from the fund anyway, so in the present situation to join the Agreement and sign the Affiliation Agreement with the Fund in practice means that the company will have a 0 rate of the fiscal NOx-tax of 16,14 NOK a kg NOx, and will have to pay 4 NOK a kg NOx to the fund. The 0 rate will be effective from the day the Agreement is signed and the Fund get it by pdf. We will then return the Participant Certificate. This certificate is a valid document that may be used towards Norwegian Tax Authorities.

NOx tax on domestic NOx-emissions, amended as per 01.01.2010
News Please note that the Norwegian NOx-Tax will increase to NOK 16,14 per kg NOx as from 01. January 2010.

The NOx Fund:
In joining the NOx Fund, the NOx-Tax will be reduced to NOK 4,00 per kg NOx, and you have the right to apply for funds to carry out technical measures to reduce NOx emissions. The application must be for dedicated ships.

It should be noted that the Customs (TAD - Toll & Avgiftsdirektoratet) is expected to carry out further checks in order to identify ships not paying liable NOx-Tax and if discovered, a double NOx-Tax will be levied.

General News: Adjustment of Intermunicipal Harbour and Anchoring Fees as from 01.01.2010
News New Harbour- and anchoring fees as from 1st January 2010

The Intermunicipal Port Authorities have adjusted the harbour and anchoring fees in our port area, which also includes the anchorages used by vessels calling at the Kaarstoe Gas Terminal. The fees are based o­n vessel GRT.

The Harbour dues have been adjusted to Nok 0,23 per grt.
Minimum payable fee is Nok 175,00

The anchoring fee is 10% of the official wharfage, and is charged day by day (payable for minimum 24 hours) o­n the following basis:

For the first 300 grt Nok 0,060 pr ton / pr day
For the next 300 grt Nok 0,055 pr ton / pr day
For the next 600 grt Nok 0,047 pr ton / pr day
For the next 800 grt Nok 0,044 pr ton / pr day
For the next 1000 grt Nok 0,039 pr ton / pr day
For the next 2000 grt Nok 0,036 pr ton / pr day
For the next 5000 grt Nok 0,032 pr ton / pr day
All above 10000 grt Nok 0,030 pr ton / pr day

General News: New fees for Pilotage Services from 01.January 2010
News The Norwegian Coastal Authorities (NCA) have proposed increased fees for pilotage services as from 1st January 2010 as follows (the proposal may however be subject to changes, as it is expected to be sanctioned by end of December 2009).

General Coastal Dues: Nok 0,26 pr grt (charged for inward andoutward passage)Entry- and departure dues: Nok 0,99 pr grt for the first 3000 grt,
then Nok 0,87 pr grt for the remaining grt.
Distance sailed under pilotage: Nok 11,18 pr nautical mile (minimum 15 n.m.)
Pilotage dues (inward and outward) based o­n vessel grt, and charged hour by hour for as long as the pilot is o­n board, however payable for minimum 3 hours.

Hourly rates as follows (based vessel grt):
From 0 to 1000 grt; Nok 825,00
From 1001 to 2000 grt; Nok 1037,00
From 2001 to 4000 grt; Nok 1222,00
From 4001 to 8000 grt; Nok 1402,00
From 8001 to 12000 grt; Nok 1534,00
From 12001 to 20000 grt; Nok 1703,00
From 20001 to 30000 grt; Nok 1862,00
From 30001 to 50000 grt; Nok 1994,00
From 50001 to 100000 grt; Nok 2127,00
From 100001 grt and above; Nok 2264,00

Saftety fee: Nok 0,99 pr grt for calls at Kaarstoe, and Nok 0,27 pr grt for other ports in our district.

Pilot ordering fee / re.ordering fee: Nok 1.500,00 (this may apply if vessel is not ready or present at the time when pilot has been ordered).
